Meliá Store Terms and Conditions of Purchase

What is Meliá Store?
Meliá Store is a website owned, managed and operated by Prodigios Interactivos, S.A., with registered office at Calle Gremio Toneleros nº 22, 07009 Palma (Mallorca) (hereinafter, ‘Prodigios’), a company belonging to the group whose parent company is Meliá Hotels International, S.A.

Meliá Store allows its users (hereinafter, the ‘Customers’ or ‘Users’) to purchase the products offered on the website (hereinafter, the ‘Products’), subject to the provisions of these terms and conditions (the ‘Terms and Conditions of Purchase’), in addition to the provisions of the Terms and Conditions of Use [https://store.melia.com] of the website.

Before purchasing any Products offered for sale at Meliá Store, please read these Terms and Conditions of Purchase carefully. By purchasing any Product, you agree to be bound by these Terms and Conditions of Purchase.

Is Meliá Store compatible with the MeliáRewards loyalty programme?
The purchase of Products through Meliá Store allows Customers who are members of the MeliáRewards loyalty programme of Meliá Hotels International, S.A., operated by Prodigios (hereinafter, the ‘MeliáRewards Programme’), to earn points under said MeliáRewards Programme. However, Customers may not replace payment of all or part of the price of their purchases at Meliá Store for the redemption of points from the MeliáRewards Programme.

The number of MeliáRewards Programme points earned will be indicated with each purchase. Points will be earned once the Product return period has expired.

To earn MeliáRewards Programme points, you must register or log in as a MeliáRewards member before starting the purchase process.

Who are the sellers of the Products?
Although Prodigios facilitates the purchase of Products through Meliá Store, Prodigios is not the seller or distributor of the Products. The relationship for the purchase of Products through Meliá Store is established directly between the Customer and the seller of each Product. Meliá Store provides detailed information about the seller of each Product. Likewise, the fact that Meliá Store receives payments from Users on behalf of sellers does not in any way imply that it assumes any responsibility for Prodigios.

Before purchasing any Product, check the seller’s information carefully. All sellers of Products are professional sellers and, therefore, the sale and purchase of Products is subject to the consumer protection regulations in force at any given time. 

The purchase agreement entered into when a Customer purchases Products through Meliá Store is binding exclusively on the seller of said Product and the Customer. Prodigios is not a party to said purchase agreement, does not at any time act as a seller and, consequently, is not subject to any obligation or liability arising from the status of seller of the Products.

Sellers are responsible for selling the Products and handling any complaints from Customers regarding the Products.

Where can I find information about the Products?
Prodigios is not the manufacturer or seller of the products sold at Meliá Store.

Meliá Store provides information about the Products as supplied by the sellers, although the packaging and materials of the products may contain additional or different information from that appearing on Meliá Store.

Before using the Products, we recommend you to carefully read the labelling, warnings, documentation and instructions accompanying the Product. However, the User must bear in mind that due to technological limitations and/or the subjective visual perception and idea of each User, Products displayed on the website may differ slightly from the Products received, such as colour tone, volume, weight, texture or shine, without such discrepancies being the responsibility of Prodigios or attributable to misleading or fraudulent advertising.

What is the price and availability of the Products?
The prices of the Products are those that appear on Meliá Store next to their description.

Prodigios may not guarantee the availability of the Products. If any of the Products included in an order is not available, we will inform you and refund the amount of said Product as soon as possible.

How does the purchase process work?
You can purchase Products by following these steps:

  1. Shopping cart. Any Meliá Store Products may be added to the shopping cart, even if they are from different sellers. At any time, the Customer may access the list of Products added to the Shopping Cart and the total price (including VAT) and proceed to process the order. Upon completion of the order, the Customer has various registration or log-in options available to continue with the purchase process.
  1. Shipping. Once you have registered or logged in, you must indicate the address where you want the Product to be delivered. Shipping costs are included in the purchase price of the Products.
  1. Payment. The payment options will appear on the screen. Once you have entered your payment details, you must confirm the payment by following the instructions provided by the payment service providers.

  2. Confirmation. Once the payment has been processed and confirmed, the purchase is confirmed. The order confirmation will appear on the screen and the Customer will receive a confirmation email with a copy of the Terms and Conditions of Purchase attached.


What are the shipping conditions for the Products?
Each seller manages the delivery system for their Products, either directly or by contracting transport services. During the sales process, an estimated delivery time will be indicated and during the shipping process you will be provided with specific information about the estimated delivery date of the Products.

Currently, Products may only be purchased for delivery to certain countries in the Eurozone, which will be identified during the purchase process.

The risk of the Products shall pass to the Customer from the moment they are made available at the delivery address indicated.

If, at the time of delivery of the Products to the address indicated by the User, the User is absent or no one collects the Product, the User must contact the shipper as soon as possible to arrange a new delivery date. If the delivery of the Product to the User has not been made for reasons not attributable to Meliá Store or the shipper, the Products will be returned to the seller and the User shall bear the shipping and return costs, as well as any associated management costs.

How can I track my shipment?
The shipment of the Product will be tracked by sending the following emails when:

  • The Product is ready for shipment.

  • The Product has been shipped. In this case, the tracking number and estimated delivery date will be provided.

If Products are purchased from more than one seller, the emails indicated will be sent by each seller.

During the shipping process, you may receive additional information about the status of your shipment from the shipper. The shipper may contact you to arrange delivery of the Products.

When and how can I return the Products?
The deadline for returning Products (right of withdrawal) is 14 calendar days from the date of delivery of the Product.

Products may be returned provided they are in perfect condition, including accessories, documentation and packaging.

The direct cost of returning the Product shall be borne by the Customer. The specific cost of the return may vary depending on the area of collection. You may make returns:

    1. Through Meliá Store, from the contact section.

    2. By sending an email to infomeliastore@melia.com.

Once the return request has been received, an email will be sent to the Customer with instructions on how to proceed with the collection of the Product and the direct cost of return.

Once the goods have been received by the seller and their condition has been verified, an email will be sent to the Customer to confirm acceptance of the return and the amount will be refunded to the same payment method used for the purchase, the direct cost of the return will be deducted, within a period not exceeding 14 calendar days from the date on which the decision to return the Product was communicated.

Even if the order is cancelled before delivery, it must be received and subsequently returned in accordance with the terms indicated.

How can I request an invoice?
You can request invoices for your Product purchases via infomeliastore@melia.com. To request an invoice, you must fill in the necessary details. The invoice will be issued by the seller of the Product and will be provided by email.

What are the warranties of the Products?
Products that are durable goods have a three-year warranty from the date of delivery of the Product, under the terms provided for in consumer and user protection regulations. This legal warranty is provided by the seller of each Product.

To exercise the warranty right, you must submit the sales document to the seller. This document will be the receipt proving the purchase of the Product through Melia Store or the Product purchase invoice issued by the Seller.

In addition to the legal warranty, some Products may have an additional commercial warranty granted by the manufacturer or the seller.

The terms and conditions of these warranties (legal and, where applicable, commercial) will be available on the website of each seller of the Products and/or, where applicable, on the packaging or documentation of the Product.

Prodigios shall not be liable for the fulfilment of the obligations of the legal warranty or the commercial warranty by the sellers.

How can I contact customer service?
Although the Products are sold by the sellers, Prodigios provides customer service to address any issues related to the order.

Electronic notifications
All communications and notifications sent to you by Prodigios or the sellers of the Products will be made by electronic means such as email or notifications via the Meliá Store website. Communications sent by electronic means therefore comply with any written requirements established in applicable legislation, unless another specific form of communication is mandatory.

Minors
Only adults may purchase Products. Persons under the age of 18 may only use Meliá Store under the supervision of their mother, father or guardian.

Amendment of these Terms and Conditions of Purchase
Prodigios may amend these Terms and Conditions of Purchase at any time by publishing the changes on Meliá Store. You will be subject to the Terms and Conditions of Purchase available at the time of purchase.

Severability
If any of the conditions of these Terms and Conditions of Purchase are deemed invalid, void or unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of the remaining conditions.

Applicable law and jurisdiction
These Terms and Conditions of Purchase shall be governed by and construed in accordance with the laws of the Kingdom of Spain.

Any disputes or discrepancies arising from the interpretation and/or application of the Terms and Conditions of Purchase shall be subject to the jurisdiction of the Courts and Tribunals of Palma de Mallorca (Spain) and higher courts, except for Users who are consumers, in which case the competent courts shall be those provided for in the applicable regulations on the competent jurisdiction of consumers and users.
